API Terms

In addition to our general Terms of Service (http://foodspotting.com/terms), which are incorporated herein by this reference, if you use the Foodspotting application programming interface (“Foodspotting API” or “API”), about which you can find information at http://foodspotting.com/developers, you must accept the following API license agreement and terms. Capitalized terms not defined herein shall have the meaning set forth in our general Terms of Service.

  • You are granted a limited, non-sublicensable right to access the API, use the Services and Content for your personal, non-commercial, and informational use only. By way of example (and not limitation), a use is considered to be commercial if the primary purpose of your application is to derive revenue. Commercial users are required to obtain approval from Foodspotting by contacting “team [at] foodspotting [dot] com” prior to implementation of the Foodspotting API. We reserve the right, without notice and in our sole discretion, to terminate your license to use the API, and to block or prevent future access to and use of the API.
  • Your license to the Foodspotting APIs under this TOS shall continue until it is terminated by either you or Foodspotting. You may terminate the license by discontinuing use of all or any of the Foodspotting APIs. Foodspotting may change, suspend, terminate, or discontinue any aspect of the Foodspotting APIs at any time, including the availability of any Foodspotting APIs or the presence of advertising from third party advertisers. Foodspotting may also impose limits on certain features and services or restrict your access to parts or all of the Foodspotting APIs or the Foodspotting Site or mobile apps without notice or liability. Foodspotting shall not be liable to you or any third party should Foodspotting exercise its right to modify or discontinue the Service or part of it. 
  • You must provide attribution on any screen or page where Content is displayed by:
    • Displaying the text, “Powered by Foodspotting,” where “Foodspotting” links to http://www.foodspotting.com
    • Optionally displaying the Foodspotting word mark, eye logo or chicklet next to this attribution text, linking back to http://www.foodspotting.com, as long as it is less prominent than the logo or mark that primarily describes your application and does not imply any partnership or endorsement by Foodspotting.
    • Including the following disclaimer: “This product uses the Foodspotting API but is not endorsed by Foodspotting.”
  • Content provided to you through the Foodspotting API may contain the trade names, trademarks, service marks, logos, domain names, and other distinctive brand features of Foodspotting, its partners, or other third party rights holders of content displayed by us. You may not delete or in any manner alter these trade names, trademarks, service marks, logos, domain names, and other distinctive brand features.
  • You may not access or use the Foodspotting APIs in a product or service that replicates or attempts to replace the essential user experience of Foodspotting or is substantially similar to or directly competes with products or services offered by Foodspotting (as determined by Foodspotting in its sole discretion);
  • You must not access or use the Foodspotting API through automated means, such as to scrape data from Foodspotting. You may only display Content in response to a user action or request;
  • You may not access or use Foodspotting APIs in a manner that adversely impacts the stability of Foodspotting servers or adversely impacts the behavior of other applications using the Foodspotting APIs;
  • You may not cache or retain any copies of the Content without prior written permission from Foodspotting, and then if you do cache any data, you must keep any cached data up to date. Content removed by users must be removed from your application and cache as soon as reasonably possible. You must also immediately remove from your application within 24 hours any Foodspotting user’s photos or other information that the owner of the photo asks you to remove;
  • All calls to the Foodspotting API must reference the API key issued to you as an approved licensee;
  • You are limited to one thousand (1000) calls to the Foodspotting API per day. Foodspotting may approve higher daily call limits in its sole discretion if you adhere to these API terms and obtain prior written permission. 
  • You agree to keep the API key confidential, and not to share it with any third party. This license is personal to you, and any affiliates must seek and obtain their own license and API Key.  You are responsible for all activity that occurs under your API Key. 
  • You may not sell, lease, or sublicense Foodspotting APIs or access thereto or derive revenues from the use or provision of Foodspotting APIs, whether for direct commercial or monetary gain or otherwise, unless you obtain prior written approval from Foodspotting;
  • You agree that you will provide the Content to users on "as is" terms, with disclaimers, limitations on liability, and use restrictions (in each case for the benefit of Foodspotting) which are substantially equivalent to those set forth in these Terms of Service and/or a link to these Terms of Service. 
  • You may not present the Content (or permit the Content to be presented) so that it appears to be available from a third party site;
  • You may not separately extract and provide or otherwise use data elements from the Content to enhance the data files of your service or of third parties;
  • You further agree not to otherwise reproduce, modify, distribute, decompile, disassemble or reverse engineer any portion of the Foodspotting API or any data provided by Foodspotting;
  • You may not delete, obscure, or in any manner alter any warning, notice (including but not limited to any copyright or other proprietary rights notice by Foodspotting or our third party partners and sponsored), or link that appears in the Service or the Content;
  • You must not attempt to cloak or conceal your identity or your application’s identity when requesting authorization to use Foodspotting APIs;
  • You must disclose in your application, through a privacy policy or otherwise displayed in the footer of each page: how you collect, use, store, and disclose data collected from visitors, including, where applicable, that third parties (including advertisers) may serve content and/or advertisements and collect information directly from visitors and may place or recognize cookies on visitors’ browsers; that you share user data with Foodspotting, for use by Foodspotting for its own purposes; and that the end user must read and agree to the Foodspotting Privacy Policy located at http://foodspotting.com/privacy. Your privacy policy must also provide a means for users to disable the application, upon which you shall permanently delete all user data.
  • You must prominently notify and obtain affirmative consent from an end user prior to collecting his or her location or user data by the API;
  • You may not include functionality in your applications that requests or collects Foodspotting usernames or passwords.
  • You may only collect or use Personal Information from Foodspotting users only if users expressly agree to share this information with you via Foodspotting’s authenticaiton system. You may use this information solely as necessary to provide Foodspotting-related services to the end user and must make no further use of it and delete it when you have no further use for it, including, without limitation, when the end user has withdrawn consent. Disclosure or use of Foodspotting end user data for any other purpose by you is not permitted. You shall take commercially reasonable steps, compliant with applicable laws, rules and regulations, to protect Foodspotting end user data from unauthorized use, disclosure or access by third parties;
  • You acknowledge that the Foodspotting Services, including but not limited to the Foodspotting API, may incorporate third party services and content and that your use and display of such third party services and content may be subject to separate terms of service policies. These third party policies can be found at the applicable third party sites.
  • You may not use the Foodspotting APIs for any application that constitutes, promotes, or is used in connection with spyware, adware, or other malicious programs or code.
  • Foodspotting reserves the right to charge for certain levels of use or commercial use of the API now or in the future.
  • Foodspotting reserves the right to terminate your API access if you are in violation of any of these terms or for any reason, without notice, at any time.

If we modify these API Terms (as permitted in our Terms of Service), we will contact all users of the API.
